License and Terms of Use of Content

This document is about the earlier Purple app (coins, exchange, withdrawals, bonus boxes and games), which is switched off. For Purple today, read the Terms of Use, the Privacy Policy and the Community rules.

This document (the "License") sets out the terms on which Purple Ltd, a private limited company incorporated in the Republic of Cyprus (the "Company"), grants you the right to use the Purple service. The License forms part of the Purple Terms of Use. By using the service you agree to this License; if you do not agree, stop using the service.

1. Subject of the License

The License covers the following components of the Purple service (together, the "Service"):

  • Mini App — the Purple application inside Telegram, available through the official bot @Purple_telegram_bot;
  • Site — the informational website thepurple.site, including the help centre (/help), the "Purple Help" assistant, the blog (/blog) and the documents section (/legal);
  • updates and materials — subsequent versions and features of the Mini App and the Site, help texts, guides, illustrations, assistant answers and messages of the support bot.

The Service contains no software to be set up on a computer or phone: it runs inside Telegram and in the browser. Your account in the Service is your Telegram account.

2. Grant of License

Subject to your compliance with this License and the Terms of Use, the Company grants you a limited, non-exclusive, revocable, non-transferable and non-sublicensable license to use the Service for its intended purpose: completing provider tasks, receiving rewards in coins, exchanging coins for dollars, withdrawing dollars and inviting friends.

The License is granted solely for personal, non-commercial use from a single account by a person aged 18 or older. No fee is charged for access. The Company may offer paid subscriptions or additional features; their terms, price and scope are announced in the application at launch.

3. Restrictions

Unless expressly permitted by law or in writing by the Company, you may not:

  1. copy, publish, distribute, sell or otherwise transfer the Service or any part of it;
  2. modify the Service or create derivative products based on it;
  3. decompile, disassemble or otherwise attempt to obtain the source code or algorithms of the Service;
  4. use bots, scripts, emulators or other automation tools to interact with the Service, view advertising or complete tasks;
  5. circumvent protection measures, limits and anti-fraud checks, including through VPN, proxies, device spoofing or multiple accounts;
  6. use the Service to build a competing product;
  7. exploit the Service commercially: resell access, coins or rewards, or complete tasks for others for a fee;
  8. automatically collect (scrape) data from the Service, the Site, the help centre or the assistant's answers;
  9. sell, transfer or lend your account, or use someone else's account.

4. Intellectual Property and the Purple Brand

The Service and everything it consists of belongs to the Company or its licensors and is protected by copyright, trademark and other intellectual property laws. This applies to the Purple name, the logo and the "C" coin mark, the interface design, icons, illustrations, animations, all interface, help, blog and document texts, and the code of the Mini App, the Site, the server side and the support bot.

The License transfers no ownership rights in the Service to you; all rights not expressly granted in this document are reserved by the Company. You may not use the Purple name, logo or coin mark in domain names, channel, application or product names, or in any way that suggests partnership with or endorsement by the Company.

5. Digital Items within the Service

Coins and dollars on the balance are digital items of the Service. They are licensed, not sold: you receive a limited right to use them within the Service.

5.1. Coins

Coins are the internal reward unit for completed tasks; the reference ratio is 1,000 coins = USD 1. Coins are not cryptocurrency, electronic money, a means of payment or a security; they cannot be transferred between users and confer no ownership, share in the Company or right to its income.

5.2. Exchange and Dollars

Coins are exchanged for dollars in the application; a 17% fee is already included in the rate, with a minimum of 1 coin. Dollars are exchanged for coins without a fee, with a minimum of USD 1. Dollars are the withdrawable balance: withdrawals from USD 1 to Telegram Wallet or a Visa/Mastercard card, funds arrive within 48 hours, and Purple charges no withdrawal fee; dollars are displayed rounded down to the cent. A payout may be delayed or declined for review on suspicion of multiple accounts, automation or fraud, or where the provider has cancelled the action.

5.3. Bonus Boxes

Bonus boxes were part of the earlier Purple app and no longer exist. Purple today has Forms instead. Forms are opened with Purple Token, and their rules are in section 7 of the current Terms of Use.

The Company may change accrual rules and the exchange rate, and cancel accruals obtained in breach of the License. Digital items have no value outside the Service and are non-refundable except where required by law.

6. User Content and Feedback

The Service is not intended for publishing content; the Company does not store the content of your communication on partner platforms. If you send the Company ideas, suggestions, reviews or bug reports ("Feedback"), you grant the Company a perpetual, royalty-free, irrevocable, worldwide license to use, modify, publish and implement them without any obligation to credit you or pay compensation.

7. Third Parties and Third-Party Components

The Service works together with third-party services that this License does not cover; by using them you accept their terms:

  • Telegram — the platform within which the Mini App and the support bot operate;
  • Telegram Wallet — a third-party wallet for payouts; the Company does not control its operation, limits or availability;
  • Adsgram — the advertising network that supplies videos and tasks under its own policy; confirmation of completion comes from the network or the provider;
  • partner platforms (including Coomeet) — independent services with their own terms and age verification; the Company does not control their decisions on moderation, blocking or payouts and has no access to your profiles there;
  • payment systems Visa/Mastercard — process card payouts under their own rules and timelines.

The Service contains open-source components used under their own licenses; those licenses apply to the respective components instead of this License.

8. Security, Telemetry and Anti-Fraud

To operate, protect and keep the Service fair, the Company processes: Telegram account data (identifier, name, username, language); gender from the profile — solely to determine available tasks under provider requirements; balances and the history of accruals, exchanges and withdrawals; task completion and advertising view events; technical telemetry (device type, client version, errors) for security and for detecting automation and multiple accounts; payout data — the Telegram Wallet address or card details, which are stored encrypted and used only for payouts.

The Company applies automated and manual checks to detect bots, emulators, self-referrals, fake actions and cancellation of actions after accrual. Following a review, an accrual may be cancelled and a payout delayed or declined. Detailed data processing terms are set out in the Terms of Use.

9. Updates and Changes to Features

The Company may at any time update the Service and add, change, temporarily disable or remove features, tasks, providers, limits, exchange rates and withdrawal methods without prior notice. Updates are subject to this License. The Company is not obliged to release updates or to keep any feature available. By continuing to use the Service after changes, you accept them.

10. Termination of the License

You may terminate the License at any time by ceasing to use the Service. The Company may restrict, suspend or terminate your License without prior notice if you breach the License or the Terms of Use, including by creating multiple accounts, using automation, deceiving providers, abusing invitations or interfering with the operation of the Service. Upon termination, coins and other digital items obtained in breach are cancelled. Sections 4–8 and 11–14 survive termination.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available". The Company does not warrant that the Service will operate without interruption or errors, that a particular task will be available or confirmed by the provider, that the reward amount or exchange rate will remain unchanged, or that using the Service will bring you any particular income. To the extent permitted by law, the Company gives no warranties, express or implied.

12. Limitation of Liability

To the extent permitted by law, the Company is not liable for indirect, incidental or consequential damages, loss of income, data or reputation, or for the actions of the third parties referred to in Section 7. The Company's aggregate liability to you for claims related to this License is limited to the dollar amount on your balance in the Service at the time the claim arose. Nothing in this section limits liability that cannot be limited by law.

13. Governing Law

This License is governed by the laws of the Republic of Cyprus, without regard to its conflict-of-law rules. Disputes not resolved through support are heard by the competent courts of the Republic of Cyprus, unless mandatory provisions of the law of your country of residence provide otherwise.

14. Relationship with the Terms of Use and Contacts

This License supplements the Purple Terms of Use (https://thepurple.site/en/legal/terms-of-use). On matters of intellectual property and licensing the License prevails; on all other matters the Terms of Use prevail. If any provision is held invalid, the remaining provisions remain in force. The Ukrainian, Russian and English texts are translations of a single document. A new version of the License is published on the Site with the date of update and takes effect upon publication.
